These General Terms and Conditions of Sale govern all sales concluded on the Safwa Boutique website (safwaboutique.com), owned by ADI COMPANY SAS , 107 boulevard National, 13003 Marseille – France.

Safwa Boutique sells: perfumes, books, natural products, clothing .

Placing an order implies full and complete acceptance of these Terms and Conditions.


ARTICLE 1 – PRINCIPLES

These General Terms and Conditions express the entirety of the obligations of the parties.
These terms and conditions apply to the exclusion of all other conditions, including those applicable in-store.

The terms and conditions may be modified at any time. The applicable version is the one in effect at the time of the order.

Terms and conditions valid until December 31, 2025 .


ARTICLE 2 – CONTENT

These Terms and Conditions define the rights and obligations within the framework of the online sale of products offered by Safwa Boutique.

They only concern:

  • purchases made from the Safwa Boutique website

  • Deliveries within mainland France or Corsica

  • For French overseas territories and international orders: contact boutique.safwa@gmail.com


ARTICLE 3 – PRE-CONTRACTUAL INFORMATION

In accordance with Article L.221-5 of the Consumer Code, the customer acknowledges having received, in a legible manner:

  • essential characteristics of the products

  • Price including VAT

  • potential additional costs

  • delivery methods

  • seller's identity and contact details

  • legal guarantees

  • Functionality and compatibility of digital content (if applicable)


ARTICLE 4 – ORDER

The customer can place orders 24/7 from the online catalogue.

To validate the order, he must:
✔ Accept the Terms and Conditions
✔ Choose the delivery address and method
✔ Confirm payment

The order is now final:

  • after email confirmation

  • after payment has been received

In case of a problem (payment, address, error), Safwa Boutique reserves the right to block the order.

ARTICLE 5 – ELECTRONIC SIGNATURE

Validation of payment constitutes proof of the customer's agreement and the enforceability of the sums due.

Any fraudulent use of a bank card must be reported immediately.


ARTICLE 6 – ORDER CONFIRMATION

A confirmation email is sent automatically after validation.


ARTICLE 7 – PROOF OF TRANSACTION

Safwa Boutique's computerized records provide evidence of communications, orders, and payments.

The invoices are archived on a reliable medium.


ARTICLE 8 – PRODUCT INFORMATION

The products offered are available while stocks last.

The photos are not contractual.

The seller cannot be held liable for any unintentional errors.


ARTICLE 9 – PRICE

Prices are expressed in euros (€) including VAT.

They do not include delivery charges (indicated before payment).

Any change in VAT or tax will be applied automatically.


ARTICLE 10 – PAYMENT METHODS

Order with obligation to pay.

Accepted methods:

  • Bank card

  • PayPal

The seller may refuse an order in the event of a payment issue.


ARTICLE 11 – AVAILABILITY – REFUND – TERMINATION

Shipping time: within 24 working hours (excluding exceptional periods).

Estimated delivery times:

  • France: 2 to 7 days

  • Maximum legal limit: 30 days

In case of delay, the customer can request:

  • new date

  • Contract termination if the delay is an essential criterion

  • refund within 14 days

In case of stock shortage:
✔ Refund within 14 days

✔ replacement


ARTICLE 12 – DELIVERY

Delivery means the transfer of possession or control of the product.

Terms :

  • delivery to the address indicated

  • reshipping fees if the address is incorrect

  • mandatory check of the condition of the package

  • In case of damaged packaging → refuse the package

In case of an anomaly:
✔ handwritten reservations
✔ Confirmation to the carrier within 2 business days
✔ copy to seller

Returns must be requested within 14 days of delivery.


ARTICLE 13 – DELIVERY ERRORS

Any claim must be made on the same day or the first working day after delivery:

A return number will be assigned.
Products must be returned complete and in perfect condition.

Return shipping costs are the responsibility of the seller in case of an error on their part.


ARTICLE 14 – GUARANTEES

14.1 Legal guarantee of conformity

(Articles L.217-3 to L.217-20 of the Consumer Code)

  • valid for 2 years

  • repair or replacement at the customer's choice

  • Proof not required for 24 months (nine)

14.2 Warranty against hidden defects

(Articles 1641 to 1649 of the Civil Code)

Allows for a cancellation of the sale or a price reduction.


ARTICLE 15 – RIGHT OF WITHDRAWAL

Legal deadline: 14 days after delivery.

Terms :

  • unused product

  • mint condition

  • complete (packaging, instructions, accessories)

  • return shipping costs are the responsibility of the customer

Refund within 14 days.

Excluded products:

  • custom products

  • opened hygiene products (perfumes, cosmetics)

  • non-physical digital content already started

  • newspapers, magazines

  • products that are likely to deteriorate quickly


ARTICLE 16 – FORCE MAJEURE

Any external and unforeseeable event (disaster, strike, network failure, etc.) suspends the obligations of the parties.

If the event lasts more than 3 months, the contract may be terminated.


ARTICLE 17 – INTELLECTUAL PROPERTY

All site content is protected.
Any reproduction is strictly prohibited.


ARTICLE 18 – DATA PROCESSING AND FREEDOM OF INFORMATION TECHNOLOGY

Personal data is collected for order processing.

The customer has their rights (access, rectification, erasure, objection).

ARTICLE 19 – PARTIAL INVALIDITY

If one clause is invalidated, the others remain applicable.


ARTICLE 20 – NON-WAIVER

The failure to invoke a right does not constitute a waiver.


ARTICLE 21 – HEADINGS

The titles are only used to facilitate reading.


ARTICLE 22 – LANGUAGE OF THE CONTRACT

Only the French version is valid in case of dispute.


ARTICLE 23 – MEDIATION

Mediation is available in accordance with Article L.616-1 of the Consumer Code.
